Background
In the original case, our client was owed spousal support from her former spouse. The amount of support owed had been in dispute, leading to a court case that was appealed to the Court of Appeals. In the first appeal, the Court of Appeals ordered an increase in our client’s support. However, in a subsequent appeal, the Court of Appeals determined that our client was not entitled to retroactive interest on the increase in her support amounts. We disagreed with that decision, and our client decided to appeal to the Oregon Supreme Court, the highest court in Oregon.
Argument and Decision
Andrew W. Newsom presented our argument before the Oregon Supreme Court, asserting that the Court of Appeals had erred by denying interest on past-due amounts. Mr. Newsom argued that existing precedent required that interest be awarded as a matter of right.
Ultimately, the Oregon Supreme Court agreed with our argument and reversed the decision of the Court of Appeals. The judgment was remanded to the trial court for entry of a judgment that included retroactive interest.
